2. Eligibility

You must be at least 16 years old to use WayWhisper. By using the Service, you represent that you meet this age requirement. If you are between 16 and 18 years old, you confirm that you have your parent or guardian's consent to use the Service.

3. Beta Status & Service Availability

WayWhisper is currently in beta. The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time. Features, content, coverage areas, and functionality may change, degrade, or be discontinued at any time without prior notice.

We may perform maintenance, updates, or migrations that result in temporary unavailability. We are not liable for any loss or inconvenience caused by downtime, latency, data loss, or service interruptions.

4. Use of the Service

WayWhisper provides location-based audio narrations for exploration and entertainment purposes only. You may use the Service for personal, non-commercial purposes. You agree not to:

• Reverse-engineer, scrape, crawl, or systematically download content from the Service
• Redistribute, sublicense, or resell narrations, audio files, or any other content
• Use the Service to build a competing product or service
• Circumvent access controls, invite code requirements, or rate limits
• Impersonate others or submit fraudulent information
• Use automated tools (bots, scripts) to access the Service without our written consent

5. Physical Safety Disclaimer

WayWhisper is designed to be used while walking, cycling, or moving through physical environments. You are solely responsible for your personal safety while using the Service. Always be aware of your surroundings, obey traffic signals, and exercise caution, especially when:

• Crossing streets or navigating intersections
• Walking in unfamiliar areas, at night, or in low-visibility conditions
• Using headphones or earbuds that may reduce your awareness of traffic, other people, or hazards
• Navigating uneven terrain, stairs, or construction zones

We strongly recommend using open-ear headphones or keeping the volume at a level that allows you to hear your surroundings. WayWhisper is not a navigation or safety tool, and we are not liable for any injury, accident, or harm that occurs while using the Service.

6. Content Accuracy & AI-Generated Content

WayWhisper narrations are created using a combination of open data sources, AI language models, editorial review, and community contributions. While we take reasonable steps to verify content accuracy (including multi-source fact-checking), we do not guarantee that any narration, description, historical fact, opening hour, address, or other information is accurate, complete, or up to date.

Trust category labels (Verified Fact, Well Documented, Community Fact, Local Legend, Personal Memory, Insider Tip) indicate the nature and source type of content, not a guarantee of accuracy. Content labeled as “Local Legend” or “Personal Memory” is explicitly presented as unverified storytelling.

AI-generated content may contain errors, hallucinations, outdated information, or culturally insensitive statements despite our editorial review process. You should independently verify any information before relying on it for decisions including but not limited to travel planning, business visits, dietary choices, accessibility needs, or safety.

7. Third-Party Content & Images

WayWhisper displays images sourced from Wikimedia Commons and other openly licensed sources. These images are used under their respective licenses (typically CC BY-SA, CC BY, or public domain). We make reasonable efforts to verify licensing, but we do not guarantee that all images are correctly licensed or free from third-party rights.

If you believe any content on WayWhisper infringes your copyright or intellectual property rights, please see Section 9 (Copyright & DMCA).

8. Data Attribution

WayWhisper uses data from the following open sources:

• OpenStreetMap — Open Data Commons Open Database License (ODbL). © OpenStreetMap contributors.
• Wikidata — Creative Commons CC0 (public domain)
• Wikipedia — CC BY-SA 4.0; content is rewritten and enriched, not directly reproduced
• Wikivoyage — CC BY-SA 3.0; travel guide context used for enrichment
• Wikimedia Commons — images used under their individual licenses (CC BY-SA, CC BY, or public domain)
• GeoNames — Creative Commons Attribution (CC BY 4.0)

9. Copyright & DMCA

We respect intellectual property rights. If you believe that content available through WayWhisper infringes your copyright, please send a notice to legal@waywhisper.com including:

• A description of the copyrighted work you claim has been infringed
• The specific URL or location within WayWhisper where the infringing content appears
• Your contact information (name, email, mailing address)
• A statement that you have a good-faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

We will investigate all legitimate notices and take appropriate action, which may include removing or disabling access to the allegedly infringing content.

10. User-Generated Content

If you submit stories, corrections, ratings, or other content as a contributor, you grant WayWhisper a non-exclusive, worldwide, royalty-free, perpetual license to use, display, modify, and distribute your contributions within the Service. You retain ownership of your original content.

You represent and warrant that your contributions:

• Are your original work or you have the right to submit them
• Do not infringe any third party's intellectual property, privacy, or other rights
• Do not contain hate speech, defamation, intentionally misleading information, or illegal content
• Do not contain personal data about identifiable individuals without their consent

We reserve the right to review, edit, refuse, or remove any user-generated content at our sole discretion. All community submissions go through an editorial review process before publication.

11. Payments, Subscriptions & Refunds

WayWhisper offers both free and paid tiers. Paid features are processed securely through Stripe. We do not store your credit card or payment details on our servers.

• Subscriptions renew automatically at the end of each billing period (monthly or annual). You can cancel at any time from your account settings or via the Stripe customer portal. Cancellation takes effect at the end of the current billing period.
• One-time purchases (city packs, routes, lifetime access) are non-recurring and provide permanent access to the purchased content.
• Refunds: In accordance with EU consumer protection law, you have a 14-day right of withdrawal from the date of purchase. To request a refund, contact support@waywhisper.com. Refunds for digital content that has been fully downloaded or streamed may be limited where permitted by law.
• Price changes: We may adjust pricing for future billing periods with at least 30 days' notice. Existing subscriptions will honor the current price until the next renewal after the notice period.

12. Limitation of Liability

To the maximum extent permitted by applicable law, WayWhisper, its operators, affiliates, and contributors shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage resulting from your use of the Service
• Errors, inaccuracies, or omissions in any content, including AI-generated narrations
• Unauthorized access to or alteration of your data or transmissions
• Service interruptions, downtime, latency, or technical failures
• Actions of third parties, including other users or contributors

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to WayWhisper in the 12 months preceding the claim, or 50 EUR, whichever is greater.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold harmless WayWhisper, its operators, and contributors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms, abuse of the platform, or at our sole discretion. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Locally stored data (IndexedDB) remains on your device until you clear it.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Hungary. The Service is operated by D3 Sign Bt., registered in Hungary. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Budapest, Hungary. If you are an EU consumer, you retain any mandatory consumer protection rights granted by the law of your country of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Changes to Terms

We may update these Terms as the Service evolves. Material changes will be communicated through the Service or via email if you have provided one. Continued use of WayWhisper after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service.
